California’s New Employment Laws for 2015

Many of the employee-friendly ordinances and employer liability regulations that were codified in California’s Legislature in 2014 have taken effect. Employers and workers are strongly encouraged to stay up-to-date on the recent changes, employers should take action immediately to revise and update their current work policies and procedures for what’s to come in the New Year.

Here are some of the most significant changes in California’s employment laws for 2015:

Mandatory Paid Sick Leave: Starting on July 1, 2015, all employers (with limited exceptions) will be required to provide California employees with a minimum of three paid sick days to those currently denied sick time, such as temporary, part-time, and seasonal workers.

Expanded Discrimination/Harassment Protections for Volunteer/Unpaid Interns: As an extension of the existing California Fair Employment and Housing Act, volunteers and unpaid interns will receive the same protections against discrimination or harassment when seeking training, work experience or employment.

Discrimination Based on Driver’s License: Under AB 1660, employers are prohibited from discriminating against undocumented immigrants using special driver’s licenses to verify their identities. It is also unlawful for employers to require an individual to present a driver’s license unless possessing a driver’s license is required by law for the job.

Protections for Rescue Personnel Expanded: AB 2536 is an expansion of an existing law in which employers are prohibited from discriminating against or discharging employees that must take time off to perform emergency duties, such as a reserve peace officer, volunteer firefighter or emergency rescue worker. The law now includes officers, employees or members of disaster medical response teams. Employees are also required to notify their employers of their emergency rescue worker status.
