The Probate Process

When the owner of an estate passes away (referred to as the decedent), their will nominates who is going to be the executor of their estate. The nominated executor must then file a petition with the Superior Court in order to actually become executor. If there is no will or no nominated executor, the law or the probate code will provide a list of individuals who would have priority for petitioning for the executor.

Then, once the petitions are submitted or an executor is appointed by will, the court will hold a hearing where relatives and heirs can deny or accept the appointment of the executor, and/or challenge the validity of the will. After these tasks and others are completed, another petition is filed in order to start the distribution of the estate among the decedent's heirs. If granted, the petition allows the estate to be distributed to the heirs as the will intended. This process is mostly the same when a person dies without a will.

The appointed executor will:

  • Determine the extent of the decedent’s estate
  • Organize their assets
  • Pay off unpaid debts
  • File tax returns
  • Manage assets of the estate

After these task and others are completed, another petition is filed in order to start the distribution of the estate among the decedent’s heirs. If granted, the petition allows the estate to be distributed to the heirs as the will intended.
